Senior Counsel, Environmental & Regulatory

The Senior Counsel, Environmental & Regulatory reports to the Managing Counsel, Environmental & Regulatory and will work with colleagues across a large corporate law department in a publicly traded, international energy company. 

 

Responsibilities May Include:

  • Providing corporate-wide fuels regulatory counsel, including on renewable fuels issues.
  • Providing day-to-day advice and counsel to operating facilities on environmental and regulatory issues, compliance counseling, and enforcement resolution. 
  • Expertise in Clean Air Act, Clean Water Act, TSCA, and PSM issues.
  • Demonstrated ability to strategically collaborate with cross-functional corporate teams across a wide-ranging spectrum of issues, including greenhouse gas regulatory initiatives and environmental justice concerns across the downstream and midstream industry.
  • Expertise and experience in emergency and crisis response, including incident reporting and investigation.
  • Expertise and experience in all aspects of agency regulatory development and oversight, including effective participation in the rulemaking process and administrative appeals.
  • Expertise and experience in litigating final HSE agency actions, including permit appeals and judicial challenges.
  • Demonstrated ability to work collaboratively with and effectively communicate across all levels of a large corporate enterprise, ranging from first-year HSE personnel to executive officers.
  • Knowledge and understanding of RMP, PSM, and PHMSA regulations.
  • Demonstrated ability to cost-effectively leverage and manage outside counsel resources.
  • Proven ability to develop and conduct internal legal training, both formally and informally.

 

Required Qualifications: 

  • Legally authorized to work in the job posting country
  • J.D. degree from a law school accredited by the American Bar Association
  • A member in good standing of any U.S. bar
  • Working knowledge of one or more of the following: Clean Air Act, Clean Water Act, CERCLA/Superfund, EPCRA, NEPA, TSCA, Renewable Fuel registration, Endangered Species Act, Oil Pollution Act, Safe Drinking Water Act, RCRA, Solid Waste Disposal Act, OSHA, or PHMSA
  • 8 or more years of health, safety, environmental regulatory, and operational experience; 10+ years preferred
  • Up to 10 % travel

 

Preferred Qualifications:

  • Experience with compliance counseling, advising on environmental matters in corporate and commercial transactions, due diligence, and interactions with applicable regulatory agencies.  Subject matter familiarity should include air emissions, fuels regulations – both traditional and renewable – industrial and hazardous waste, water quality, wetlands, endangered species, contaminated properties, and other state and federal environmental regulatory requirements
  • Experience in oil & gas, refining, energy, or petrochemical industries is a plus
  • Ability to work collaboratively with a highly skilled team
  • Superior mediation, negotiation, advocacy, and presentation skills, and mature judgment and discretion
  • Experience providing advice to clients in crisis management situations
  • Ability to manage and prioritize assignments that may be broad in scope and complexity, and which involve collaborative work with employees in different departments or with varying degrees of seniority required
  • Self-initiation on regular and complex assignments
  • Effective utilization and communication with internal support staff including assigned paralegal and administrative assistant
  • Excellent written and oral communication skills required
  • Ability to effectively manage and communicate with internal business clients and outside the Company with opposing and outside counsel, experts, witnesses, and vendors 
  • Ability to work independently within broadly defined objectives, being able to perform job functions without extensive supervision, take ownership of projects, and accepting responsibility
  • Ability to anticipate and address customers’ changing needs
  • Ability to learn quickly and apply Phillips 66 policies, procedures, operations, and industry practices
  • Comprehensive analytical, conceptual, problem-solving, planning, evaluation, and legal project management skills
  • Ability to prepare and present clear, concise, and persuasive oral/written opinions, reports, correspondence, and presentations required
  • Effective use of knowledge and experience in establishing and weighing alternatives for making decisions associated with area of responsibility
  • Capable of establishing professional credibility with a variety of clients and management
